1. Service Summary and Acceptance

FOM provides hosted shop operations software for order management, customer history, delivery coordination, reporting, messaging workflows, exports, and related business operations.

By registering, signing in, accepting an invite, or using the platform, you agree to these Terms & Conditions and to the Privacy Policy.

2. Eligibility and Account Responsibilities

You must be legally able to enter into a binding agreement and use the platform only for lawful business operations. Account information must remain accurate, current, and complete.

  • You are responsible for safeguarding account credentials and for activity performed under your account.
  • Shop owners are responsible for invited staff access, role assignments, and workspace governance.
  • You must not share credentials in a way that bypasses intended account or permission controls.

3. Trials, Subscriptions, and Billing

FOM is a subscription-based service. Some new shops may receive a trial period before paid service is required.

  • Billing cycle: subscriptions may be billed in advance on the plan cadence offered to the customer.
  • Activation and payment: access may depend on invoice confirmation, payment completion, or internal activation by the platform team.
  • Non-payment: overdue or unpaid invoices may result in restricted access, suspension, or termination.
  • Refunds: fees are generally non-refundable unless required by law or expressly agreed in writing.

4. Shop Data, Roles, and Workspace Use

The shop is responsible for the content it enters into the platform, including customer records, order details, delivery information, uploaded files, and message templates.

FOM provides role-based access controls, but the shop remains responsible for deciding who should be invited, what permissions they should hold, and whether the underlying data is accurate and lawfully collected.

5. Third-Party Integrations and Messaging

Some platform features depend on third-party services such as Meta Messenger, push notification providers, or external communication tools.

  • Integration availability may change because of provider policies, permissions, rate limits, outages, or account restrictions outside FOM's control.
  • You are responsible for using connected integrations lawfully and in accordance with the relevant third-party terms.
  • Automated messages, invoices, or attachments sent through integrated channels depend on those third-party services remaining available and properly configured.

6. Acceptable Use and Prohibited Conduct

You may not use the platform to:

  • violate law, regulation, privacy obligations, or third-party rights;
  • upload or transmit unlawful, deceptive, abusive, infringing, or harmful content;
  • reverse engineer, scrape, probe, or interfere with the service in unauthorized ways;
  • attempt to bypass permissions, security controls, tenant boundaries, or usage restrictions;
  • use the service to send spam, impersonate others, or automate abuse against customers or platform users.

7. Availability, Support, and Service Changes

FOM may update, improve, suspend, or discontinue features from time to time. We may also apply maintenance windows, performance controls, or emergency changes to protect the service.

Support availability, onboarding assistance, and operational response times may vary by plan, account status, or internal capacity.

8. Suspension, Termination, and Account Deletion

We may suspend or terminate access if the service is used in breach of these terms, if payment obligations are not met, or if access creates security, fraud, legal, or operational risk.

Shop users may also schedule self-service account deletion through the platform. When the grace period ends, the old account loses access and any new account created later does not automatically reconnect to the previous workspace.

9. Intellectual Property and Feedback

You retain rights to your own shop data and content. You grant FOM a limited right to host, process, transmit, back up, and display that data only as needed to provide and support the service.

FOM and its licensors retain all rights in the software, workflows, branding, design system, and platform materials. If you provide feedback or feature suggestions, we may use them without restriction or compensation.

10. Disclaimers and Limitation of Liability

The platform is provided on an "as available" basis. To the maximum extent permitted by law, FOM disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

FOM is not liable for indirect, incidental, special, consequential, or business-interruption losses, or for losses caused by third-party integrations, inaccurate shop-entered data, customer misuse, connectivity failures, or events outside our reasonable control.

11. Updates to These Terms and Contact

We may update these terms as the product, billing model, integrations, or legal requirements evolve. Continued use of the platform after an updated version becomes effective constitutes acceptance of the revised terms, unless applicable law requires additional consent.

Questions about billing, legal terms, service use, or account status should be directed to support using the contact details below.
